Funding Urgently Needed to Continue the H-2B Rules Challenge
Because of the significant impact on our members who use the H-2B Program, PLANET, along with some of our member companies, the National Hispanic Landscape Alliance, the U.S. Chamber of Congress, and other allies sued the Department of Labor (DOL) to stop the implementation of the H-2B wage rule and the H-2B program rule.
As a result of our litigation, a judge in the Northern District of Florida issued a preliminary injunction preventing the DOL from implementing its H-2B program rule on April 27, 2012. This decision was a huge victory for PLANET members. However, legal proceedings in the case continue and the legal bills are quickly adding up. The DOL has appealed the ruling to the 11th Circuit. We are hopeful that the District court will grant our request for a permanent injunction following a denial of the appeal decision. If we are successful, we believe this decision will also have a direct impact on our request for a permanent injunction of the wage rule. We are close to victory, but need your help to cross the finish line.
At this point, the litigation will come to a halt and all of the successes will be for naught unless we can quickly raise additional funding to pay for legal fees. We need to raise approximately $220,000 to pay for past legal work and to see the case through to completion. All H-2B users benefit from this ruling. We hope that all H-2B users can make a contribution to help preserve the H-2B program well into the future.
We are very grateful to the PLANET members that have donated to the cause but must again appeal to those who use the H-2B program to please make a donation to this important litigation. This lawsuit is also important for PLANET members who are not currently using the H-2B program due to the economy. If we do not act now, there will not be a usable H-2B program to turn to when the economy recovers. In a time of increasing government raids and audits of landscape companies, we must fight to preserve a workable and legal source of seasonal labor.
